REASONS

TheAPVMA hasdecidedthatthecontinueduseof,orotherdealingswithproductscontaining2,4-D HVEinaccordancewith

currentlabelinstructionsmaybelikelytohaveanunintendedeffectthatisharmfultoanimals,plantsor thingsortothe

environment.Inaddition,theAPVMA hasdecidedthattheinstructionsoncurrentlyapprovedlabelsfortheproductsmayno

longerbeadequate.

Since26September2006,registrationsofproductscontaining2,4-D HVE andassociatedlabelapprovalshavebeen

suspendedprimarilybecauseofconcernsaboutdamagetonon-targetcropsandvegetationfromHVE vapourdrift.

TheAPVMA hasissuedinstructionsfor dealingandusingsuspendedproductsduringthespraywindowbetween1Mayand

31August.Applicationof2,4-D HVEonlywithinthisspraywindowwouldminimisetheriskofunintendedharmfuleffectsto

nativevegetationandsusceptiblecrops.

INSTRUCTIONS FORPOSSESSING,HAVINGCUSTODYOF,USINGORDEALINGWITHSUSPENSEDPRODUCTS,

OR PRODUCT CONTAININGTHESUSPENDEDLABELS

Subsections45A(5)and55(3)oftheAgvetCodeceasetoapplyinrespectoftheproductsidentifiedinthetableabove.

Duringthe12monthperiodofsuspension,apersonmaynotpossess,havecustodyof,useor dealwithanyoftheproducts

other thaninaccordancewith:

theinstructionssetoutattheendofthisNotice;and

apermitissuedbytheAPVMA.

Newpermits,withmodifiedinstructionsforuse,havebeenissuedunder section114oftheAgvetCode(PER 13339foruse

duringthe‘winter window’).

Dependingonfurtherinformationthatmaybereceivedandassessedfortheongoingreviewof2,4-D products,theAPVMA

maycancelanypermit(s)andissuereplacementpermit(s)atanytimeprior totheexpirydatesonthepermits.Beforeusing,

supplyingor otherwisedealingwithproductscontaining2,4-D HVE, suppliersandusersneedtobesatisfiedthatthe

instructionssetoutattheendofthisNoticecontinuetoapply,andthattheiractivitiesareauthorisedbyapermit.Current

permitsareavailableat http://www.apvma.gov.au/permits/search.php

FailuretocomplywiththeinstructionssetoutattheendofthisNoticeattractsapenaltyunder section55(4) oftheAgvet

Code.Thepenaltyis300penaltyunits($33,000).

Itisalsoanoffencetoadvertiseor promotetheuseoftheproductsduringtheperiodofsuspension(other thanfor the

purposesofadvisingusersaboutthemodifiedinstructionsfor use).

This permit is issuedunder s.114(1)and (3) of theAgvet Codes at theAPVMA’sinitiative

followingthe APVMA’scontinued suspension ofallproducts containing2,4-D high volatile ester

(HVE; specifically2,4-Dbutyl ester, 2,4-D ethyl esterand 2,4-D isobutyl ester) on 1February

2012. Anyperson possessing, havingcustodyof or otherwise dealingwith suspended 2,4-D HVE

products or purportingtouse this permit must complywith all requirements as specifiedin the

Agvet Codeof their State.

This permit is issuedsubject to the condition that anyperson using, or purportingto use,this permit

mustdo so in accordancewith theconditions set outinthis permit.This permit also allows any

person to claim that theproducts contained withinthis permitcan beusedin the manner specifiedin

this permit.

WARNING:

From 1 February2012aperson mayonlypossess,havecustodyof, useorotherwisedeal with the

products identifiedin Attachment 1in accordancewiththe instructions included in thispermitas

contained inAttachment2.

Dependingon further information that maybereceivedand assessed fortheongoingreviewof

2,4-D products, theAPVMA maycancelanypermitand issuereplacement permit(s)at anytime

prior to theexpirydateson the permit(s). Beforeusing, supplyingor otherwisedealingwith

products containing2,4-D.

Suppliers should also notethat itis an offenceto advertise thesesuspendedproducts or promotethe

use of thesesuspended products duringthe periodofthe suspensionotherthan forthe purposeof

advisingusers ofthe newinstructions.

A person maypossess, havecustodyof, use, or otherwise deal with the product, or product containinga

suspended label onlyin accordancewith theseinstructions.

Users:

Personswho wish to useproducts containing2,4-D HVE listed in Attachment 1 must read or haveread to

them, the instructions included in Attachment 2 ofthis permit. Users who havehad the instructionsread

to them must confirm to thereader that theyunderstand the instructions.

Supply:

Product mayonlybesupplied, if acopyof theinstructions contained in Attachment 2 aresecurelyaffixed

to thecontainer.

Registrants:

All registrants must maintain records of product supplied under this permit. Specificallythe recordsmust

includethe quantityanddates ofproduct supplied, the names and addresses of thepersons suppliedthe

product and confirmation that at the timeof supplyof theproduct acopyofthe instructions in

Attachment 2 ofthis permit was securelyaffixed to all containers. Therecords must be progressively

maintained whilst thepermit is in forceand retained foraminimum periodof twoyearsfrom thedate of

expiryof this permit. Records must be madeavailable to the APVMAupon request.

Upon request beingmade, the records areto be provided:

immediatelyif therequest is verballyfrom an APVMAinspector who hasattendedthe premises,

II HEALTH HAZARD INFORMATION

Health Effects:

No specific data is available for the product for chronic exposure symptoms. The

materials in this product are not considered to be carcinogenic by the Worksafe

Australia lists. (October 1991)

Acute Effects:

Swallowed: Data suggests that the product should be considered to be

moderately toxic by ingestion.

Eye: Data suggests that the product should be classified as

moderately irritating to the eyes.

Skin: Data suggests that the product should be classified as

moderately irritating to the skin. This product may be absorbed

through the skin. This is a significant exposure route.

Inhalation: Data suggests that the product should be classified as

moderately irritating by inhalation. May cause coughing and

chest discomfort.

EMERGENCY AND FIRST AID PROCEDURES

First Aid: If poisoning occurs, contact a doctor or

Poisons Information Centre (131126).

Swallowed: If swallowed, and if more than 15 minutes from a hospital induce

vomiting, preferably using Ipecac Syrup APF.

Eye: If this product comes into contact with eyes, hold eyes open and

wash with running water for at least 15 minutes. Ensure

irrigation under eyelids by occasionally lifting eyelids. Do not

attempt to remove contact lenses unless trained. Transport to

hospital or doctor immediately if eye irritation develops.

Skin: If this product comes into contact with skin, wash skin for at

least 15 minutes with soap and water. Remove contaminated

clothing and footwear. Ensure contaminated clothing is

thoroughly washed before using again. Transport to hospital or

doctor if skin irritation develops.

Inhalation: If mists or combustion products are inhaled, remove to fresh air.

Lay victim down and keep warm and rested. If breathing is

shallow, or has stopped ensure clear airway and apply

resuscitation or oxygen if available. Transport to hospital or

doctor immediately

Eye wash stations or baths should be available where product is being used.

Advice to doctor: Treat symptomatically. Note the nature of this product.

III PRECAUTIONS FOR USE

Exposure Standards:

A TWA value of 10 and a STEL (Short Term Exposure Limit) value of “not set”

have been established for a significant ingredient of this product. Values

expressed as mg/m3. Exposure values at the STEL is an exposure value that

should not be exceeded for more than 15 minutes and should not be repeated for

more than 4 times per day. There should be at least 60 minutes between

successive exposures at the STEL. Exposure values atthe TWA (Time

Weighted Average) means the average airborne concentration of a particular

substance when calculated over a normal 8 hour working day for a 5 day working

week.

IV SAFE HANDLING INFORMATION

Engineering Controls:

In industrial situations, concentration values below the TWA value should be

maintained. Values may be reduced by process modification, use of local

exhaust ventilation, capturing substances at the source or other methods. Ifyou

believe airborne concentrations of mist, dusts or vapours are high; you are

advised to modify the process or environment to reduce the problem.

Personal protection:

Whenpreparing spray,wear PVC or rubber apron, elbow length PVC gloves

and face shield. When using the prepared spray, wear face shield. If product

gets on skin, immediately wash area with soap and water.

Respiratory Protection: A facemask or respirator should be used when this

material is being used. For help in selecting suitable equipment consult AS

1715.

Flammability Limits: Upper: Not flammable, Lower: Not flammable.

Afteruse and before eating, drinking or smoking, wash hands, arms and

face thoroughly with soap and water. After each day’s use, wash gloves, face

shields and contaminated clothing.

Storage & Transport:

No special requirements storage and transport requirements. This material is

classed as a S5 Poison. Observe appropriate state regulations for storage,

transport and sale. Containers should be kept closed in order to minimise

contamination. Keep from extreme heat and open flames, and make sure the

material does not come into contact with water or acids.

Spills and disposals:

In event of a major spill, prevent spillage from entering drains or watercourses.

Wear full protective clothing including facemask, face shield and gauntlets. Stop

leaks if safe to do so, and contain spill. Absorb onto vermiculite or other

absorbent material. Sweep up and shovel and collect recoverable product into

labelled containersfor recycling or salvage. After spills, wash area, preventing

run off from entering drains. If material enters drains, advise emergency

services. This material may be suitable for approved landfill. Dispose of only in

compliance with local, state and federal regulations. Launder all contaminated

clothing before re-use.

Explosion Hazard:

There is no explosion hazard from this material under normal circumstances.
