Continued suspension of quintozene active constituent approvals, products containing

quintozene and label approvals of products containing quintozene

Quintozene containing products have been suspended since 9 April 2010 on the basis of human health concerns due to

the potential presence of undeclared dioxin impurities. The current suspension expires on 14 February 2015.

The APVMA has decided to extend the suspension of the active constituent approvals for quintozene listed in Table 1

and the product registrations and label approvals of products containing quintozene listed in Table 2.

Continued suspension of quintozene active constituent approvals, products containing quintozene and label approvals of products

containing quintozene

The active constituent approval suspension is in effect from 14 February 2015 until 13 November 2015.

The product and label suspensions apply as a consequence of the decision to continue the suspension of quintozene

active constituent approval and are in effect from 14 February 2015 until 13 November 2015.

BASIS FOR THE CONTINUATION OF THE SUSPENSION

The APVMA became aware of information in 2009 indicating the presence of undeclared dioxins as impurities in

products that contain quintozene as the active constituent. On this basis, the APVMA suspended quintozene active

approvals effective from 9 April 2010 until 14 July 2014. The APVMA has decided to continue this suspension for a

further year until 13 November 2015.

Dioxins are listed as toxicologically significant impurities in the Definition of Standards for Active Constituents (see

www.apvma.gov.au/node/10706). The presence of any impurity that is listed as toxicologically significant is a matter that

the APVMA considers to be a relevant particular to the approval of an active constituent. An active constituent approval

is not supportable unless any impurities of toxicological significance have been declared, quantified and evaluated.

The APVMA considers that the active constituent quintozene may be an undue hazard to the safety of people exposed to

it during its handling and may have an effect that is harmful to human beings. A full assessment of the dioxin impurities

has not been conducted in accordance with section 14 of the Agvet Code Act. On this basis the APVMA has concluded

that it cannot allow the active constituent to be supplied and used in chemical products when it contains undeclared

dioxins. Consequently, based on section 41(1)(b) of the Agvet Code Act, the APVMA has suspended the approvals of

quintozene active constituents.

The Agvet Code provides that if the APVMA suspends the only approval, or all the approvals, of an active constituent for

an existing chemical product, it must also suspend any registration of that product. In addition, if the APVMA suspends

the registration of a chemical product, it may also suspend any approval relating to a label for containers for the product.

INSTRUCTIONS FOR DEALING WITH SUSPENDED ACTIVE CONSTITUENTS AND PRODUCTS

Unless authorised by the APVMA, the following instructions apply to persons having possession or custody of stocks,

and are considering using or otherwise dealing with suspended active constituent and product during the period of

suspension.

INSTRUCTIONS FOR POSSESSING, HAVING CUSTODY OF, USING OR DEALING WITH SUSPENDED ACTIVE

CONSTITUENTS AND PRODUCTS

Possession and custody

Possession and custody of existing stocks of quintozene active constituent and/or products is permitted.

Supply

No supply of the active constituent quintozene and/or any product that contains it as an active constituent is permitted.

Use

No use of suspended product containing quintozene is permitted

With the exception of permit; PER14681.

Any person who possesses or has custody of, or otherwise deals with the active constituents or products listed in Tables

1 and 2 (above) in accordance with the instructions in this notice is taken to have been issued with a permit to possess,

have custody of, or deal with the active constituents or products during the period of suspension or until further notice.

WARNING

A person must not possess with the intent to supply, or deal with any materials containing quintozene during this period,

except in accordance with the instructions contained in this notice. A failure to comply with these instructions will result in

an offence against the Agvet Codes and the APVMA will take appropriate compliance action. It is an offence for any

person to possess with the intent to supply, use or deal with the active constituent after 9 April 2010 unless authorised to

do so by the APVMA. Similarly, it is an offence for any person to possess with the intent to supply, use or deal with

quintozene products after 9 April 2010, unless authorised to do so by the APVMA.

GENERAL INSTRUCTIONS:

This product must only be applied through professional application equipment in licensed seed

treatment plants. It is not a product for on-farm use. Ensure the application equipment is accurately

calibrated and that peanut seed is evenly dusted.

FUNGICIDE

For fungicide resistance management, Peanut Seed Protectant Fungicide is both a Group X and a

Group Y fungicide.

Some naturally occurring individual fungi resistant to the product Peanut Seed Protectant Fungicide

and other Group X and/or Group Y fungicides may exist through normal genetic variability in any

fungal population. The resistant individuals can eventually dominate the fungal population if these

fungicides are used repeatedly. These resistant fungi will not be controlled by this product and other

Group X and/or Group Y fungicides, thus resulting in a reduction in efficacy and possible yield loss.

Since the occurrence of resistant fungi is difficult to detect prior to use, Crompton Specialties Pty

Ltd accepts no liability for any losses that may result from the failure of Peanut Seed Protectant

Fungicide to control resistant fungi.

PRECAUTIONS:

Do not use treated seed for animal or human consumption. Do not allow treated seed to contaminate

grain or other seed intended for animal or human consumption. Do not feed treated seed, or

otherwise expose, to wild or domestic birds.

DO NOT use bags which have held treated seed for any other purpose.

PROTECTION OF CROPS, NATIVE AND OTHER NON-TARGET PLANTS:

Treated seed should not be held over from one sowing season for sowing in subsequent seasons.

PROTECTION OF LIVESTOCK:

DO NOT feed treated seed to animals, including poultry. It is important that any treated seed not

used for sowing is destroyed. Bags which have held treated seed should not be used for any other

purpose. When treated seed is stored, it should be kept apart from other grain and the bags (or other

containers) should be clearly marked to indicate the contents have been treated with Peanut Seed

Protectant Fungicide.

DO NOT allow stock to graze in any treated area, or cut for stock food.

PROTECTION OF WILDLIFE, FISH, CRUSTACEANS AND ENVIRONMENT:

Dangerous to fish. DO NOT contaminate streams, rivers or waterways with the chemical or used

containers or with bags which have held treated seed.

STORAGE AND DISPOSAL:

Store in the closed, original container in a dry, cool, well-ventilated area out of direct sunlight.

Shake empty bag into application equipment. Do not dispose of undiluted chemicals on-site.

Puncture or shred and bury empty containers in a local authority landfill. If no landfill is available,

bury the containers below 500 mm in a disposal pit specifically marked and set up for this purpose

clear of waterways, desirable vegetation and tree roots. Empty containers and product should not be

burnt.

with eyes and skin. Repeated exposure may cause allergic disorders. Do not inhale

Wash thoroughly with soap and water. Remove contaminated clothing and

launder before reuse.

Inhaled:

Remove to fresh air. If breathing difficulties occur, seek medical advice.

PRECAUTIONS FOR USE

EXPOSURE STANDARDS:

Recommended hygiene standard (TWA) by the National Occupational Health and Safety Commission

for: Quintozene = 0.5 mg/m

Captan = 0.5 mg/m

ENGINEERING STANDARDS:

Sufficient ventilation to minimize dust exposure. Protect closed dust handling systems against possible

dust explosions. Keep containers closed when not in use.

PERSONAL PROTECTION:

Avoid all personal contact. When using, do not eat, drink or smoke. Wear cotton overalls buttoned to the

neck and wrist, a washable hat, elbow-length PVC gloves, a face shield and disposable face mask. In the

absence of adequate ventilation, use a respirator fitted with an agricultural chemical cartridge(s). If

product on skin, immediately wash area with soap and water. After use and before eating, drinking,

smoking or using the toilet, wash hands, arms and face thoroughly with soap and water. Launder clothing

before storing or re-using.

FLAMMABILITY:

USE:

Use product through State Health Department licensed seed treatment plants only.

SAFE HANDLING INFORMATION

STORAGE AND TRANSPORT:

Not classed as a Dangerous Good by the Australian Code for the Transport of Dangerous Goods by Road

or Rail. This material is a Scheduled Poison (S6) and must be stored, maintained and used in accordance

with the relevant regulations. Store in original container, away from seeds, fertilizers, foodstuffs and

oxidizing agents. Keep dry and out of direct sunlight. Store below 40

C. Keep containers closed when

not in use.

SPILLS:

Vacuum up to avoid creating dust. Transfer into secure containers for proper disposal. Use personal

protective equipment as outlined above. Do not contaminate watercourses or drains with the product or

containers. Do not reuse the container for any purpose. If there is contamination of crops or waterways,

advise emergency services or State Department of Agriculture.

DISPOSAL:

Disposal after intended use: Break, crush or puncture and bury empty containers in a local authority

landfill. If not available, bury the containers below 500 mm in a disposal pit specifically marked and set

up for this purpose clear of waterways, vegetation and roots. Empty containers and product should not be

burnt.

Disposal after accident or spill: Dispose of sealed containers at an approved local waste disposal site.

FIRE / EXPLOSION HAZARD:

Not Flammable: However, in case of fire protect against inhalation of combustion products which

consist of oxides of sulfur and carbon and maybe oxides of nitrogen, phosgene and hydrogen chloride

(HCI). Reacts with oxidizing agents and strong acids and alkalis.
