REASONS

TheAPVMA hasdecidedthatthecontinueduseof,orotherdealingswithproductscontaining2,4-D HVEinaccordancewith

currentlabelinstructionsmaybelikelytohaveanunintendedeffectthatisharmfultoanimals,plantsor thingsortothe

environment.Inaddition,theAPVMA hasdecidedthattheinstructionsoncurrentlyapprovedlabelsfortheproductsmayno

longerbeadequate.

Since26September2006,registrationsofproductscontaining2,4-D HVE andassociatedlabelapprovalshavebeen

suspendedprimarilybecauseofconcernsaboutdamagetonon-targetcropsandvegetationfromHVE vapourdrift.

TheAPVMA hasissuedinstructionsfor dealingandusingsuspendedproductsduringthespraywindowbetween1Mayand

31August.Applicationof2,4-D HVEonlywithinthisspraywindowwouldminimisetheriskofunintendedharmfuleffectsto

nativevegetationandsusceptiblecrops.

INSTRUCTIONS FORPOSSESSING,HAVINGCUSTODYOF,USINGORDEALINGWITHSUSPENSEDPRODUCTS,

OR PRODUCT CONTAININGTHESUSPENDEDLABELS

Subsections45A(5)and55(3)oftheAgvetCodeceasetoapplyinrespectoftheproductsidentifiedinthetableabove.

Duringthe12monthperiodofsuspension,apersonmaynotpossess,havecustodyof,useor dealwithanyoftheproducts

other thaninaccordancewith:

theinstructionssetoutattheendofthisNotice;and

apermitissuedbytheAPVMA.

Newpermits,withmodifiedinstructionsforuse,havebeenissuedunder section114oftheAgvetCode(PER 13339foruse

duringthe‘winter window’).

maycancelanypermit(s)andissuereplacementpermit(s)atanytimeprior totheexpirydatesonthepermits.Beforeusing,

supplyingor otherwisedealingwithproductscontaining2,4-D HVE, suppliersandusersneedtobesatisfiedthatthe

instructionssetoutattheendofthisNoticecontinuetoapply,andthattheiractivitiesareauthorisedbyapermit.Current

permitsareavailableat http://www.apvma.gov.au/permits/search.php

FailuretocomplywiththeinstructionssetoutattheendofthisNoticeattractsapenaltyunder section55(4) oftheAgvet

Code.Thepenaltyis300penaltyunits($33,000).

Itisalsoanoffencetoadvertiseor promotetheuseoftheproductsduringtheperiodofsuspension(other thanfor the

purposesofadvisingusersaboutthemodifiedinstructionsfor use).

This permit is issuedunder s.114(1)and (3) of theAgvet Codes at theAPVMA’sinitiative

followingthe APVMA’scontinued suspension ofallproducts containing2,4-D high volatile ester

(HVE; specifically2,4-Dbutyl ester, 2,4-D ethyl esterand 2,4-D isobutyl ester) on 1February

2012. Anyperson possessing, havingcustodyof or otherwise dealingwith suspended 2,4-D HVE

products or purportingtouse this permit must complywith all requirements as specifiedin the

Agvet Codeof their State.

This permit is issuedsubject to the condition that anyperson using, or purportingto use,this permit

mustdo so in accordancewith theconditions set outinthis permit.This permit also allows any

person to claim that theproducts contained withinthis permitcan beusedin the manner specifiedin

this permit.

WARNING:

From 1 February2012aperson mayonlypossess,havecustodyof, useorotherwisedeal with the

products identifiedin Attachment 1in accordancewiththe instructions included in thispermitas

contained inAttachment2.

Dependingon further information that maybereceivedand assessed fortheongoingreviewof

2,4-D products, theAPVMA maycancelanypermitand issuereplacement permit(s)at anytime

prior to theexpirydateson the permit(s). Beforeusing, supplyingor otherwisedealingwith

products containing2,4-D.

Suppliers should also notethat itis an offenceto advertise thesesuspendedproducts or promotethe

use of thesesuspended products duringthe periodofthe suspensionotherthan forthe purposeof

advisingusers ofthe newinstructions.

A person maypossess, havecustodyof, use, or otherwise deal with the product, or product containinga

suspended label onlyin accordancewith theseinstructions.

Users:

Personswho wish to useproducts containing2,4-D HVE listed in Attachment 1 must read or haveread to

them, the instructions included in Attachment 2 ofthis permit. Users who havehad the instructionsread

to them must confirm to thereader that theyunderstand the instructions.

Supply:

Product mayonlybesupplied, if acopyof theinstructions contained in Attachment 2 aresecurelyaffixed

to thecontainer.

Registrants:

All registrants must maintain records of product supplied under this permit. Specificallythe recordsmust

includethe quantityanddates ofproduct supplied, the names and addresses of thepersons suppliedthe

product and confirmation that at the timeof supplyof theproduct acopyofthe instructions in

Attachment 2 ofthis permit was securelyaffixed to all containers. Therecords must be progressively

maintained whilst thepermit is in forceand retained foraminimum periodof twoyearsfrom thedate of

expiryof this permit. Records must be madeavailable to the APVMAupon request.

Upon request beingmade, the records areto be provided:

immediatelyif therequest is verballyfrom an APVMAinspector who hasattendedthe premises,

Health Effects:

No specific data is available for the product for chronic exposure symptoms. The ingredients are not listed as

carcinogenic in Worksafe’s document “Exposure Standardsfor Atmospheric Contaminants in the Occupational

Environment” (May 1995), nor in NOHSC’s “Listof Designated Hazardous Substances” (April 1999).

Acute Effects:

Swallowed:Data suggests that this product is harmful if swallowed.

Eye:This product is irritating to the eyes. It will cause discomfort such as stinging pain, watering and redness of the

eyes. Effects may last after exposurehas ceased, and in severe exposure,long lasting or even permanent effects

such as corneal damage can occur.

Skin:Data suggests that this productmay be absorbed through the skin and be harmful by skin absorption. Major skin

exposure may lead to health problems. Thisproduct is also irritating to skin. Itis likely to cause discomfort and effects

such as moderate to severe itchiness, blistering and skin reddening.

Inhalation:Data suggests that thisproduct is harmful if inhaled. Minor or short term exposure may lead to short term

Swallowed:If swallowed, do NOT induce vomiting. Wash mouth withwater and give a glass of water to drink. Seek

medical attention.

Eyes:If this product comes into contactwith eyes, hold open and wash with running water for at least 15 minutes.

Ensure irrigation under eyelids by occasionally lifting them. Donot try to remove contactlenses unless trained. Seek

medical attention.

Skin:If product gets on skin, immediately remove contaminatedclothing and wash skin with soap and water for at least

15 minutes. If irritation persists or if you beginto feel unwell, seek medical attention.

Inhalation:If vapours or mists have been inhaled, and irritation orunusual symptoms have developed, remove to fresh

air and observe until recovered. If irritation or symptomspersists more than about 30 minutes, seek medical advice.

lll PRECAUTIONS FOR USE

Risk Phrases are: R20/21/22, R36/38. Harmful by inhalation, in contact with skin,and if swallowed. Irritating to eyes

and skin.

Exposure Standards:

A time weighted average (TWA) concentration for an 8 hourday, and 5 day week has not been established by NOHSC

Australia for any of the major ingredients in this product. There is a blanket limit of 10mg/m 3 for dusts or mists when

limits have not otherwise been established.The ADI (Acceptable Daily Intake) for2,4-D is set at 0.01mg/kg/day. The

corresponding NOEL (No-observable-effect-level) is set at 1mg/kg/day. Values taken fromAustralian ADI List, January

2001.

Engineering Controls:

In industrial situations, concentrationvalues below the TWA value should bemaintained. Values may be reduced by

process modification, use of local exhaust ventilation, capturing substances at the source, or other methods. If you

believe air borne concentrations of mists, dusts or vapours are high, you are advised to modify the process or

environment to reduce the problem.

Personal Protection:

Respiratory Protection:If there is a significant chance of dusts, vapours or mists accumulating in the area where this

Protective Gloves:Impermeable protective gloves should be wornwhen you are using this product, since absorption

Spills & Disposals

In the event of a major spill, prevent spillage from entering drains or water courses. Immediately call the Fire Brigade.

Wear full protective chemically resistant clothing including face mask, face shield, gauntlets and self contained

breathing apparatus. See above under Personal Protectionregarding Australian Standards relating to personal

protective equipment. Stop leak if safe to do so, and contain spill. Absorb onto sand, vermiculite or other suitable

absorbent material. Sweep up and shovel or collect recoverable product into labelled containers for recycling or

salvage, and dispose of promptly. Can be slippery on floors,especially when wet. After spills, wash area preventing

runoff from entering drains. If a significant quantity of material enters drains, advise emergency services. Full details

regarding disposal of used containers, spillage and unused material may be found on the label. If there is any conflict

between this MSDS and the label, instructions on the label prevail. Dispose ofonly in accord with all regulations.
